In this case of first impression in the Commonwealth, we consider the validity of a provision in the uninsured motorist portion of a Virginia insurance policy which required the insured to secure the insurer’s consent prior to settlement with any person or organization “who may be legally liable” for causing bodily injury or property damage. We also consider the validity of the subrogation clause contained in the “Conditions” portion of the insurance policy in question.
